Criminologist says if someone breaks into your home, the Criminal Code gives you a lot of latitude
METRO VANCOUVER (NEWS 1130) – A man has been charged with murder in a crime that has shocked the region.

Khouri Green is accused of shooting Colin Hill as he broke into his home. Hill was at home with his family at the time of the attack late Sunday night.

Criminologist Neil Boyd says this type of crime, where the victim dies in his own home and didn’t know his attacker, is relatively rare in Canada.

“It’s always a worry, of course, for people to hear a noise, hear of somebody breaking in. It’s somewhat neighbourhood-dependent. The more vulnerable neighbourhoods are more prone to an attack,” he explains.

Boyd says when it comes to these circumstances, the Criminal Code gives you a lot of latitude.

“Obviously, you’re not going to shoot somebody who’s [just on] your property, but if you use deadly force in defense of your home, it’s extremely unlikely that you would be held accountable.”

Green has been charged with second-degree murder.

In general the law actually allows you to defend yourself with the same amount of force being applied. For example knives against knives, guns against guns. Going beyond that can actually get you in trouble. Furthermore using any restricted or prohibited weapons in self defense will definitely get you criminal charges. The argument is you can't possibly retrieve such weapons in time if properly stored. So stick with the good old fashioned shotgun and keep a clean toy pistol around for planting.

sphelps is a hundred percent correct, restricted firearms will be a bit tough to explain to the cop or the judge once the intruder has been neutralized. 12 gauge will be the best bet. I would love to see AR's get on the none-restricted list as long as its 18.5 barrel length, never made sense to me when you can keep a sks in the none-restricted segment when it can be easily converted to an full auto that shoots 30 cal but not an AR that shoots 223. Anyways, that's a discussion for anther thread on anther forum...

I lived in Surrey once. Guy tried to steal my car, couldn't get it started. Guy comes back next night, removes ignition, couldn't get it started. I take it to shop for repairs (in Surrey), probably same guy tries to steal it again, can't get it started but does relieve me of 5k stereo system. Glad I moved

Despite being named crime capital of Canada 2 years running a few years ago here I still feel safer living here than anywhere in the lower mainland.

I lived in Chicago for 4 years, felt safer walking around that city ( 1000 + murders a year) than the lower mainland, there is a special kind of people here. Thankfully most of the gangbangers here learned how to be a thug by watching Boys in the Hood, and shoot sideways. Unfortunately they also are mentally unstable ( insecure) which makes them unpredictable.
