i paided with paypal sent three emails with him weeks prior to the order and told him he had a week to ship

Too bad he doesnt have a phone number listed anywhere and he rarely replies to emails...? Kinda makes this hard to do.

I payed already with PayPal and yes the "placed" order has already been payed for. Still nothing I've contacted him 4 times now with no reply.

Open a dispute with paypal and let them know you have not received the product; and/or cannot contact the seller.

You should have no problem getting the money back.
