B.C. man sets off class-action lawsuit against UPS over hidden brokerage fees

VANCOUVER (CP) - Hidden fees seem to be an everyday irritant for consumers, but a B.C. man is so angry about a fee charged by United Parcel Service he's willing to become the point man for a class-action lawsuit.

It started after Robert Macfarlane purchased an amplified telephone device from Arizona over the Internet last year.
He knew he would have to pay shipping and handling fees and government levies, but he was also ordered to pay a $38.40 brokerage fee charged by UPS.

"It's outrageous," said Macfarlane's lawyer Jim Poyner.


"It's a surcharge that nobody agrees to, nobody knows anything about it until the delivery person is at the door."
Poyner said Tuesday he expects hundreds of thousands of people have been in the same situation across the country and there are plans to file a similar lawsuit in Ontario. "It's certainly a problem that affects the entire country."

I hope they can do something, I found out when I ordered an $8 keychain and had to pay the $38 brokerage fee. A couple times they have sent me a bill as well after paying at the door. So you have to call them so it doesn't go to collection. Like they would ever leave you the package if you haven't paid.
Now I ask for anything but UPS when getting stuff shipped.

the same thing will happen with any courier service.

When getting stuff from the USA I always ask for USPS.

I hope he gets other people to back him.UPS isnt the only one doing it,but if one goes down the rest will pay attention.I always use the post office or a trucking company when I can.Small brokerage fee with the post office.With most trucking companys you have to find your own broker,but then you can shop for the cheapest.

I found out when Kent Marine sent me up a replacement bucket Of salt for the one I bought with low DKH.

good for mr macfarlane. interesting thing when Kent sent me the replacement, i didn't have to pay a thing but i believe it was fedex not UPS

The problem for me is that nobody can tell you what the fee structure is. Sometimes it's 38 bucks, sometimes it's 138 bucks. I've even called in a advance to find out what it's going to be but they can't even tell me that.....

I've spent the past six months trying to get UPS to fix this same mistake for my Kent salt replacement. It was clearly stated on the shipping documents that the duty and any related expenses were to be billed back to the shipper (Kent), yet UPS couldn't seem to figure that out. I made numerous calls and sent faxes of all the documents to them, yet they still had a hard time correcting it. I called back the following week to re-check that it had been cleared (as advised by the lady I spoke with) and sure enough it was not fixed. Another hour on the phone and they supposedly fixed it. I haven't heard anything more, but I plan to follow up again with them. Now, I also have to check my credit reports to make sure the idiots didn't mess up that with their collection agency BS.

I refuse to ship with either UPS or FedEx for international purchases. I did get a new motorcycle suit shipped by UPS earlier this year, but the value was high enough that the duty charges were not unjustifiable, and I still saved a bundle over what the Canadian retailers wanted for the same suit.

I'm in the same boat. UPS dinged me some $50 a few years back for a mislabeled parcel. I sorted it out at their request, got the extra duty refunded by the government, then UPS turned around and told me the fee was not refundable.

Pfft, no wonder their colour of choice is brown.
