Got to side with Mike there, that 1516 law is weee a bit outdated, pretty sure it was put in place to prevent substitutions for grains and hops which I imagine at the time in Germany were quite rare...

I believe 3 feet is the recommended minimum to prevent all the water from freezing solid. However I think most stick to 2 feet because anything deeper qualifies as a pool and would require a railing...
